Agreement: By booking any safari or service with BoostSafaris, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

1. Definitions

  • "Company" refers to BoostSafaris
  • "Client/Guest" refers to the person(s) booking our services
  • "Services" include safari tours, accommodation, transportation, and related activities
  • "Booking" refers to any reservation made for our services

2. Booking and Payment Terms

2.1 Booking Confirmation

  • All bookings are subject to availability
  • A booking is confirmed only after receipt of deposit payment
  • Written confirmation will be provided via email
  • Prices are quoted in USD unless otherwise specified

2.2 Payment Schedule

  • Deposit: 30% of total cost required to confirm booking
  • Balance: Due 30 days before departure date
  • Bookings made less than 30 days before departure require full payment
  • Late payment may result in booking cancellation

3. Pricing and Inclusions

3.1 Price Inclusions

Unless otherwise specified, safari packages include:

  • Accommodation as specified
  • Meals as outlined in itinerary
  • Transportation in safari vehicles
  • Professional guide services
  • Park entry fees
  • Game drives as per itinerary

3.2 Price Exclusions

Unless otherwise specified, safari packages exclude:

  • International airfare
  • Visas and travel documents
  • Travel insurance
  • Personal expenses and shopping
  • Alcoholic beverages (unless specified)
  • Tips and gratuities
  • Medical expenses

4. Travel Requirements and Responsibilities

4.1 Client Responsibilities

  • Ensure valid passport (minimum 6 months validity)
  • Obtain necessary visas and permits
  • Arrange appropriate travel insurance
  • Follow all health and vaccination requirements
  • Arrive at designated meeting points on time
  • Respect local customs and wildlife regulations

4.2 Health and Safety

  • Clients must disclose any medical conditions or dietary requirements
  • Participation in activities is at client's own risk
  • Follow guide instructions at all times
  • Maintain appropriate travel insurance coverage

5. Itinerary and Service Changes

5.1 Itinerary Modifications

  • We reserve the right to modify itineraries due to weather, road conditions, or safety concerns
  • Alternative arrangements will be provided when possible
  • No compensation for minor itinerary changes
  • Significant changes will be communicated promptly

5.2 Accommodation Changes

  • We reserve the right to substitute accommodation of similar standard
  • Upgrades or downgrades may occur based on availability
  • Price adjustments will be made for significant changes

6. Liability and Insurance

6.1 Company Liability

BoostSafaris acts as an agent for suppliers and therefore:

  • Our liability is limited to gross negligence or willful misconduct
  • We are not liable for acts or omissions of third-party suppliers
  • Maximum liability shall not exceed the total cost of services booked
  • We are not responsible for delays, cancellations, or changes by suppliers

6.2 Client Insurance

  • Comprehensive travel insurance is mandatory
  • Insurance must cover medical emergencies, evacuation, and trip cancellation
  • Clients are responsible for verifying coverage adequacy

7. Conduct and Behavior

7.1 Expected Conduct

  • Respect for fellow travelers, guides, and local communities
  • Compliance with local laws and regulations
  • Responsible wildlife viewing and photography
  • No harassment of animals or disruption of their natural behavior

7.2 Unacceptable Behavior

We reserve the right to terminate services without refund for:

  • Illegal activities or drug use
  • Aggressive or threatening behavior
  • Damage to property or vehicles
  • Refusal to follow safety instructions
  • Disruption of other guests' experiences

8. Force Majeure

We are not liable for failure to perform services due to circumstances beyond our control, including:

  • Natural disasters, floods, or extreme weather
  • Government actions, war, or civil unrest
  • Strikes, labor disputes, or transportation failures
  • Health emergencies or pandemics
  • Acts of terrorism or security threats

9. Complaints and Disputes

9.1 Complaint Procedure

  • Report issues immediately to your guide or our office
  • Written complaints must be submitted within 30 days of trip completion
  • Include booking reference and detailed description of issues
  • We will investigate and respond within 14 business days

9.2 Dispute Resolution

  • Good faith efforts will be made to resolve disputes amicably
  • Unresolved disputes subject to Kenyan law and jurisdiction
  • Legal proceedings must be filed in Nairobi, Kenya

10. Intellectual Property

  • All content on our website is protected by copyright
  • Images and descriptions may not be used without permission
  • We may use photos taken during safaris for promotional purposes
  • Clients may request exclusion from promotional materials

11. Data Protection

Personal information is handled according to our Data Policy. By booking our services, you consent to the collection and use of your information as outlined in our privacy policy.

12. Governing Law

These Terms & Conditions are governed by the laws of Kenya. Any disputes arising from these terms will be subject to the exclusive jurisdiction of Kenyan courts.

13. Amendments

We reserve the right to modify these Terms & Conditions at any time. Changes will be posted on our website and apply to all bookings made after the effective date.

14. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
